I. Current Situation
Some sponsors may wish to terminate the services of their Arab or foreign workers (male or female) by executing a sponsorship transfer in favor of a new sponsor. However, it may subsequently become impossible to complete the transfer at the Directorate General of General Security due to administrative restrictions affecting either one of the sponsors or the worker. Likewise, some new sponsors fail to complete the sponsorship transfer for various reasons, resulting in inaccuracies in the General Security records and causing prejudice to the original sponsor.
II. Implementation
The Directorate General of General Security has established the following mechanism governing the transfer of sponsorship for Arab and foreign workers and defining the validity of waivers and undertakings executed before a Notary Public:
1. Sponsorship shall be transferred by means of a Sponsorship Transfer Application, accompanied by:
- a waiver signed by the original sponsor; and
- an undertaking signed by the new sponsor,
both duly notarized and valid for execution before the General Security offices,or by means of a Sponsorship Transfer Form completed at a General Security office in the presence of the original sponsor, the new sponsor, and the worker.
2. Waivers and undertakings executed before a Notary Public must be submitted for execution to the General Security offices within fifteen (15) days from the date of execution. Sundays, public holidays, and emergency holidays are included in the calculation of this period. Any waiver or undertaking submitted after the legal deadline shall not be accepted.
A waiver shall become effective only from the date of its execution by the Directorate General of General Security.
3. Applications for sponsorship waiver must be submitted exclusively to the Public Relations Department no later than 15 days before the expiry of the residence permit.
4. Sponsorship transfer applications shall be submitted to the regional office having jurisdiction over the new sponsor's place of residence no later than 15 days before the expiry of the residence permit.
5. The Arab or foreign worker shall continue working for, and under the responsibility of, the original sponsor until the application is approved. Only after approval may the worker commence employment with the new sponsor.
Notes
- The mandatory presence of the Arab or foreign worker (male or female) at the General Security office is required when submitting a sponsorship transfer application based on a notarized waiver and undertaking. The waiver must bear the worker's signature confirming his or her consent to transfer employment to the new employer.
- Category III workers are exempt from the requirement to appear in person when renewing their annual residence permits.
- The mandatory presence of the Arab or foreign worker (male or female) is required at the General Security office for fingerprinting and photographing when cancelling a residence permit or transferring sponsorship.
- The transfer of sponsorship is not permitted for domestic workers or for workers who have already been recruited more than twice during their period of employment in Lebanon.
